Terms of Use
Last updated: 2026-10-18
Introduction and Acceptance
Welcome to Calling Points (the "App"), operated by TF Halibut ("we", "us", or "our"). These Terms of Use ("Terms") form an agreement between you and TF Halibut only, and not with Apple Inc., Google LLC, or any other platform provider. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
Licence to Use
The App is licensed, not sold, to you. Subject to your compliance with these Terms, TF Halibut grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on Apple-branded or Android devices that you own or control, in accordance with the applicable platform's usage rules (including the Apple Media Services Terms and Conditions). Access through Apple's Family Sharing or volume purchasing programmes is permitted where applicable.
Description of Service
Calling Points helps you plan and track train journeys in the United Kingdom. It allows you to:
- Plan a journey between two stations at a chosen time
- View live and timetabled times, platforms, delays, and disruption information
- Save journeys you take and set up recurring commutes
- Share a journey as an image or a link
Calling Points is an information service. It is not a train operator and does not sell tickets.
Accuracy of Rail Information
The times, platforms, delays, occupancy, and other service information shown in the App are derived from third-party rail data feeds operated by the United Kingdom rail industry. This information may be incomplete, delayed, inaccurate, or temporarily unavailable, and predicted platforms are shown as predictions and may change. You should not rely on the App alone for time-critical decisions, and you remain responsible for checking official sources and station information when travelling. We are not liable for any loss arising from reliance on rail information shown in the App.
Account Registration
You can use the App without creating an account. If you choose to create a permanent account, you may do so with Google, Apple, or an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and you agree to notify us of any unauthorised use.
Your Content
The journeys and commutes you save remain yours. By saving them, you grant TF Halibut a non-exclusive, royalty-free licence to store and transmit that information solely to operate the App and provide the service to you across your devices.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers, networks, or infrastructure
- Attempt to gain unauthorised access to other users' accounts or data
- Use automated systems or bots to access the App or to extract data from its services in bulk
- Circumvent any security measures or access controls
Tickets and Third-Party Retailers
Calling Points is not an accredited ticket retailer. Where the App offers an option to buy tickets, it does so by handing you off to a third-party retailer, who is solely responsible for that sale and for any resulting ticket. Any purchase is subject to the retailer's own terms and privacy policy, and we are not a party to it.
Intellectual Property
The App, including its design, branding, logos, and source code, is owned by TF Halibut and protected by applicable intellectual property laws. Rail data displayed in the App remains the property of its respective owners and is used under licence. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent. You retain ownership of your content as described above.
Termination
We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to other users or to the App. You may delete your account at any time in the App; upon deletion, your data is removed in accordance with our Privacy Policy.
Maintenance and Support
TF Halibut is solely responsible for providing any maintenance and support for the App, as described in these Terms or required by law. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the App.
Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, that the rail or other information it shows will be accurate or reliable, or that any defects will be corrected. You use the App at your own risk.
In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are TF Halibut's sole responsibility.
Third-Party Services
The App relies on third-party services to deliver its functionality, including Firebase (authentication, database, and notifications), Google Sign-In, Apple Sign-In, and United Kingdom rail data feeds supplied via the Rail Data Marketplace. We do not control these services and are not responsible for their availability, accuracy, or content. Your use of them may be subject to their own terms. We shall not be liable for any loss arising from the operation or unavailability of any third-party service.
Product Claims
TF Halibut, not Apple or Google, is solely responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Claims
TF Halibut, not Apple or Google, shall be solely responsible for the investigation, defence, settlement, and discharge of any third-party claim that the App or your possession and use of it infringes a third party's intellectual property rights.
Limitation of Liability
To the maximum extent permitted by applicable law, TF Halibut shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including loss of data, loss of profits, or business interruption. Our total liability for any claim arising from or related to the App shall not exceed the greater of the amount you have paid us in the twelve (12) months preceding the claim or fifty US dollars (USD $50).
Export Compliance
You may not use or export the App except as authorised by the laws of the jurisdiction in which you obtained it. In particular, the App may not be exported or re-exported to any country or region embargoed by the United States, or to any individual or entity on any applicable sanctions or restricted-parties list. You represent that you are not located in any such country or region and are not on any such list.
Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which TF Halibut is established, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of that jurisdiction.
Changes to These Terms
We may update these Terms from time to time. We will indicate any change by updating the "Last updated" date above. Your continued use of the App after a change constitutes acceptance of the updated Terms.
Apple as Third-Party Beneficiary
You acknowledge and agree that Apple, Inc. and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
